Grundlage aller wettbewerbsrechtlichen Entscheidungen ist die Freiheitsgarantie des Grundgesetzes (GG). Das in Artikel 2 GG verankerte Recht auf freie Entfaltung der Persönlichkeit gilt auch für die Betätigung im wirtschaftlichen Bereich. Dabei wird unter wirtschaftlichem Wettbewerb jede Handlung ver standen, die darauf gerichtet ist, sich in der Auseinanderset zung gegenüber Konkurrenten einen Vorteil zu verschaffen. Es gehört zum Wesen des Wettbewerbs, daß ein Mitbewerber Kunden gewinnt, die der andere schon hat oder mit denen der rechnet. Das Streben nach Erfolg auf dem Markt kann jedoch zu Wettbewerbshandlungen führen, die eine unangemessene Beeinträchtigung der Interessen der Allgemeinheit erzeugen oder schutzwürdige Interessen Dritter tangieren. Für solche Fälle hat der Gesetzgeber und die Rechtsprechung einen Negativkatalog wettbewerbswidriger Verhaltensmuster entwickelt. Der folgende Text behandelt die bedeutenden Be stimmungen. Während die Grundsätze des Bürgerlichen Gesetzbuchs (BGB) das Gebiet des Privatrechts und das Handelsgesetzbuch die Rechtsverhältnisse der Kaufleute erfassen, bietet der Komplex "Gewerblicher Rechtsschutz" dem Gewerbetreibenden einen umfassenden Schutz seiner spezifischen betrieblichen Errun genschaften. Thema des Gewerblichen Rechtsschutzes ist da mit also nicht ein bestimmtes Anspruchsverhältnis, sondern die Interessenwahrung des einzelnen Anbieters im Verhältnis zum Wettbewerber und der Allgemeinheit. Daß der freie Wettbewerb auf Dauer funktionsfähig bleibt, dafür sorgt - das sei ergänzend erwähnt, aber nicht Inhalt 1 dieses Buches - ein anderes Gesetz: das Kartellgesetz, auch Gesetz gegen Wettbewerbsbeschränkungen (GWB) genannt.

As a new resident of Togo in 1985, Judy Rosenthal witnessed her first Gorovodu trance ritual. Over the next eleven years, she studied this voodoo in West Africa's Ewe populations of coastal Ghana, Togo, and Benin, an area once called the Slave Coast. The result is Possession, Ecstasy, and Law in Ewe Voodoo, an ethnography of spirit possession that focuses on law and morality in "medecine Vodu" orders. Gorovodu is not a doctrinal set, but rather a lingusitic, moral, and spiritual community, with both real and imagined aspects. In medecine Vodu possession, the deities evoked are spirits of "bought people" from the savanna regions, slaves who worked for southern coastal lineages, often marrying into Ewe families. Drumming and dancing rituals, replete with voluptuous trances and gender reversals, bring these "foreign" spirits back into Ewe communities to protect worshippers, heal the sick and troubled, arbitrate disputes, and enjoy themselves as they did before they died. (Rosenthal employs Bakhtin's theory of carnival to interpret the openly festive element of Gorovodu.) The changeable nature of the religion echoes the lack of boundaries of the Gorovodu family and the residents' belief that communal and individual identity are fluid rather than fixed. Numerous name changes early in this century indicated a strategy for resisting colonial control. Writing from a background of anthropology, Rosenthal carefully monitors her own role as narrator in the book, aware of the cultural distance between her and the Africans she is writing about. She intends this ethnography to mirror the "texts" of voodoo itself, a body of signifiers and meanings with which the reader must interact in order to make sense of it.

Ich bin Zeugin: Mit Galgenhumor, klug, nachdenklich und ohne Chance auf eine Veröffentlichung in der DDR der achtziger Jahre, wie das eben so war in der Diktatur. Er hatte vorher jahrelang täglich abends Tagebuch geführt, um die Spannungen seines beruflichen Lebens überhaupt auszuhalten. Das war nun sein Lebensmaterial fürs Schreiben, aber dann verwandelte er alles: Wie das so ist in der Literatur. Zu der Geschichte des Josua hat er sich eine Verlags-Lektorin ausgedacht, die vor und nach und zwischen den Kapiteln ihre verdrießlichen Kommentare abgibt. So konnte er sich auch noch über die damals herrschende Zensur lustig machen. Ursprünglich nannte er das Buch ,Josua geht' und nahm die traurigen Worte aus ,Undine geht' von Ingeborg Bachmann als Motto ,Warum sollt ich's nicht aussprechen, euch verächtlich machen, ehe ich gehe. Ich gehe ja schon.' Das hätte so schön zum Titel gepasst. Aber wundersamerweise ging Alemannien unter: Da konnte Josua bleiben und muss nicht auf den Ruinen tanzen wie auf einem der 557 Ölbilder des geretteten achtzigjährigen Johannes Helm.
